TIANANMEN

THE FIFTH REPUBLIC, AT THE HEARTH OF POWER

WHEN MULTINATIONALS ATTACK STATES

Fall 2016. Millions of citizens in Europe are taking to the streets. Wallonia has just refused to sign the free trade agreement with Canada, which triggers a crisis all over Europe. Negotiations around the treaty have revealed the existence of international arbitration tribunals. This private justice mechanism, which no one knew of, allows multinationals to sue states. They can claim huge amounts of money from them if they believe that their environmental, social or health policies are damaging their profits, real or anticipated. And who pays for it? The same taxpayers that states seek to protect.

But where does this justice come from? Essentially from free trade agreements.
To encourage multinationals to invest in their countries, governments have signed and keep signing trade agreements. Trials are held behind closed doors and are conducted by great business lawyers. More and more of them are spreading all over the world. Whether they are major powers or developing countries, they all suffer from this justice that affects our fundamental rights: health, environment, wages and human rights. Behind these agreements lies a crucial choice for the future of globalisation. Yet, what kind of globalization do we want?

This film reveals the extraordinary power of international arbitration tribunals through three symptomatic cases: in Colombia, Andres Rendle, the CEO of the Canadian company Cosigo, files an arbitration complaint against the Colombian state and claims compensation of €16 billion. In Germany, the shutdown of nuclear power plants is causing an outcry: Vattenfall, a Swedish company, is asking German taxpayers for €4.7 billion. In Peru, the American company Renco, owner of a lead smelter that poisoned the inhabitants is suing the Peruvian state by claiming €800 million in compensation.

Today, states and peoples are waking up, threatened in their sovereignty. Is it already too late?
